Penalties & Enforcement

Penalty

$577 first violation; $2,300-$5,800 subsequent

Up to $577 for first benchmarking violation; up to $2,300 for subsequent violations. Performance standard penalties (from 2030): up to $2,300 every 30 days, $5,800 for repeat violations

Annual energy benchmarking via ENERGY STAR Portfolio Manager
Pay annual benchmarking fee
Meet building performance standard targets (starting 2030)
Develop improvement plans for non-compliant buildings

12 months of energy consumption data
