Benchmarking active statewide. Recent legislation (HB25-1269) removed 2026 BPS non-compliance penalties; owners should focus on 2030 targets. State goal: 7% emissions reduction by 2026, 20% by 2030.

Penalties & Enforcement

Penalty

$577 first violation; $2,300-$5,800 subsequent

Up to $577 for first benchmarking violation; up to $2,300 for subsequent violations. Performance standard penalties (from 2030): up to $2,300 every 30 days, $5,800 for repeat violations

Annual energy benchmarking via ENERGY STAR Portfolio Manager
Pay annual benchmarking fee
